The United States Army Corps of Engineers (Corps), Great Lakes and Ohio River Division, Chicago District, requires a Chairperson to serve as a Committee person on Accounting Technical Review (ATR) Committee. The Government will not reimburse any offerors on their response to this notice.



Competition: This requirement is not a small business set-aside, but the U.S. Supreme Court (S.Ct.) decree limits competition. To be eligible for award consideration, a firm who employs the proposed committee member must not be currently performing as a paid consultant to any party (i.e., Great Lakes States, Metropolitan Sanitary District of Greater Chicago,) besides the federal government, in any proceedings relating to any of the related S.Ct. decrees (i.e., 281 U.S. 696; 289 U.S. 395; 388 U.S. 426). Current is defined as active at time of award, estimated to be May 2023 and during the almost one-year period of the contract. The Government anticipates completion of the requirement will be about January 2024.



Background: The diversion of water from the Lake Michigan watershed is of a major importance to the Great Lake states and to the Canadian province of Ontario. A 1967 S.Ct. decree limits the State of Illinois from diverting more than 3,200 cfs from Lake Michigan and The Corps, has been given the responsibility for the accounting of flow that is diverted from the Lake Michigan watershed and provide assurance to concerned interested parties. A 1980 amendment to the S. Ct. decree called for the establishment of a three-person technical committee to performing an accounting technical review of flow that is diverted from the Lake Michigan watershed.



Description: For this requirement (W912P623Q0011), the Corps requires a Chairperson to serve on a three person ATR Committee. In addition to this Modeling Expert, the Government requires under a different notice, two other ATR Committee persons: a Flow Measurement Expert (different requirement W912P623Q0009), and a Modeling Expert (different W912P623Q0010). The Government will select members based upon the expertise of highly qualified engineers and/or hydrologists. Although firms may submit a response for all three committee persons, the Corps will not make more than one award to any offeror for more than one Committee member.



The Committee will perform an: (1) analysis of current diversion-related measurement techniques and accounting procedures, (2) evaluation of these techniques and procedures as to whether they are using the best current engineering practice and scientific knowledge, (3) recommendation of appropriate revisions within the legal constraints of the decree, (4) review of the user’s manual for completeness and clarity, and (5) preparation of draft and final reports.
